Now custody in a legal sense is probably one of the most misunderstood issues that any couple deals with. Custody, I think in a lot of people’s minds, is who gets to have the children and where do they live? Well that’s part of it, but really legal custody in Arizona deal specifically with which parent gets to make important decisions about the children? There are a couple of different types of custody. There’s sole custody where one parent would be assigned by the court to make all those decisions really without any input from the other parent. Now you can imagine, that often leads to some difficulty between the parents, after all, they’re getting divorced for a reason. But most courts in Arizona prefer that the children have two parents who obviously love and care about them, making these important decisions. There are a lot of different factors that the court must consider when determining whether a party will get sole custody or whether the parents will share joint legal custody going forward.
