Do Cheaters Get Less Property of Assets in the Divorce?

As the best community property lawyers in Gilbert AZ we often get asked, “do people who cheat in their marriage get less property in the divorce?” The answer is: no. Arizona is a no fault state and we’re a community property state. The law in Arizona requires judges to equitably divide all property that the parties acquired during the marriage and they can’t take into consideration whether there has been infidelity during the marriage. That’s where the no fault part comes in. Arizona being a no fault state means that the court actually can’t even consider the reason for the divorce in granting the divorce. So in Arizona, a spouse who has been unfaithful still gets their full share of the community assets.
